Chapter I

G e n e r a l

Preamble

 

         The Georgian National Academy of Sciences is the successor to the Old Georgian Academies – Gelati and Iqalto; it is an attribute of a high level of State development and a Scientific Adviser to the Georgian Government; it is an Association of persons who have achieved international excellence in science and scholarship, and enjoy high scientific and civic prestige.

            Article 1. The Objective of the Law and its Sphere of Regulation

This  Law  sets  the status, objectives, tasks and rule of activity of the Georgian National Academy of Sciences (hereafter: Academy).

Article 2. The Legal Basis of the Activity of the Academy

In its activity  the Academy is guided  by the Georgian Constitution, the present Law, the Georgian Legislation and the Statute of the Academy.

Chapter II

The Status of the Academy, its Goals and Key Direction

 Article 3. The Legal Status of the Academy

1. The Academy is a legal entity based on membership. It is composed of Full Members (Academicians) and Corresponding Members of the Academy, as well as of Honorary Members and Foreign Members of the Academy.

2. The Academy is a Scientific Adviser to the Georgian Government.

3. The Academy is an autonomous Scientific Institution, which independently approves the Statute of the Academy, defines its structure and decides questions of the Academy's scientific organization and its staff, as well as questions of its economic and international cooperation.

4. It is impermissible to use the term "Georgian National Academy of Sciences" in a meaning different from that assumed in the present Law.

5. It is impermissible for a member of any other Academy in Georgia to be called Academician or Corresponding Member or Member of the Academy without indication of the full name of the concrete Academy, apart from a Member of the Georgian National Academy of Sciences.

 Article 4. The Objectives and Tasks of the Academy

1.      The Objectives  of the Academy are:

a)      furthering of the development of science and scholarship in Georgia in  conformity with  the achievements of World science and scholarship;

b)      resting on the intellectual potentials and professionalism of its Members, to facilitate the development of Georgian science/scholarship and its pro­motion in social life and on the international arena;

c)      furthering fundamental and applied research;

d)      forecasting the development of science/scholarship in Georgia and working  out proposals on state priorities in conformity  with achievements of World science;

e)      submission of recommendations to the Supreme Authorities of the country on possible consequences of economic and social projects under implemen­tation in Georgia and in foreign countries;

f)       care for the State Languages and perfection of scientific terminology in these Languages.

2.      In order to implement its tasks the Academy:

a)      engages in the popularization of scientific achievements and scientific heritage;

b)      arranges scientific/scholarly Discussions, Symposia and Conferences; con­ducts public lectures in General Educational, Professional and Higher Educational Institutions;

c)       issues printed and electronic Scientific Journals and other Periodicals, carries on international exchange of scientific literature;

d)       is entitled to membership in International Scientific Organizations, to estab­lish contacts with the World's leading scientists and scientific Centers;

e)      is entitled to carry on scientific research;

f)       institutes and awards prizes in the fields of science and technologies to promote significant scientific work;

g)      is entitled to set up Commissions in various fields of Science and Techno­logies;

h)      preserves personal archives of figures of science and culture that are valuable for Georgian History;

i)        considers and assesses the annual reports and completed scientific work of  Georgia's Higher Educational Institutions and Research Institutions, ref­lecting their work; to this end, the Academy is authorized  to request from these Organizations needed additional information, and inform them about the assessments made, as well as the Georgian Ministry of Science and Education and Foundations for the Development of Science;

j)        according to various fields, it awards prizes and the title of the best Research Institution;

k)      in conformity with the rules established by Georgian Legislation, it engages in other auxiliary economic activity connected with the tasks of the Academy.

Chapter III

Management of the Academy

Article 5. The Principles of Governing the Academy and the Bodies of its Management

1.      The Academy is governed on the basis of the principles of electivity, democracy and transparency.

2.      The  bodies of management of the Academy are:

a)           the General Meeting of the Academy

b)          the Academic Council

c)           the President of the Academy

Article 6. The General Meeting of the Academy

1. The General Meeting of the Academy is the highest body of management of the Academy. The Honorary Academicians and Foreign Members of the Academy also take part in the activities of the General Assembly of the Academy.

2. The General Meeting of the Academy:

a)      approves the Statute of the Academy by the decision of the General Meeting;

b)      determines the  key directions of the activities of the Academy;

c)      elects the President, Vice-Presidents of the Academy, the Academician- Secretary and other Members of the Academic Council by secret  ballot by the majority of its listed composition;

d)      recalls Members of the Academic Council before the expiration of their term, by secret ballot, with the presence of 3/5 of the listed composition of the Academy;

e)      considers and endorses the Annual Report of the Academy and submits a motivated request for subsidizing the Academy for the coming year;

f)       elects Full Members (Academicians) and Corresponding  Members of the Academy, confirms  Honorary Academicians and Foreign Members of the Academy;

g)      considers matters pertaining to  Scientific Ethics.

3. The General Meeting of the Academy is called and chaired by the President of the Academy, and, in his/her absence, by a Substitute determined by the Rules stated in the Statute of the Academy.

4. The General Meeting is convened according to the need, but at least  twice a year.

 

Article 7. The Academic Council

1. The Academic Council is comprised of the President of the Academy, the Vice-Presidents, the Academician-Secretary and other Members of the Academy. The number of the Members of the Academic Council is defined by the Statute of the Academy. The Members of the Academic Council are not Public Officers.

2. The Members of the Academic Council are elected by the General Meeting of the Academy for a 5-year term, by a majority of the composition of the Academy. The form of balloting is determined by the Statute of the Academy.

3. The Academic Council implements the decisions of the General Meeting of the Academy and, in the period between General Meetings, directs the activities of the Academy.

4. The Academic Council is accountable to the General Meeting of the Academy.

5. The Academic Council is served by Administrative Staff.

6. Other rights of the Academic Council are defined by the Statute of the Academy.

Article 8. The President of the Academy

1. The President of the Academy is a plenipotentiary representative of the Academy, both inside the Country and beyond its borders. He/She is responsible for the direction of the activities of the Academy. The President of the Academy is, at the same time, Chair of the Academic Council.

2. The President of the Academy submits the Candidates for Membership in the Academic Council to the General Assembly of the Academy.

3. The President of the Academy is elected by the General Meeting from the Full Members (Academicians) of the Academy for a 5-year term, by secret ballot and by the majority of the listed composition. The President of the Academy may not be elected for more than two terms in succession.

4. The Office of the President of the Academy is an administrative post; it is not subject to age restrictions.

5. Other rights of the President of the Academy are determined by the Statute of the Academy.

Chapter IV

The Structure of the Academy.  The Composition of the Academy and

the Allowance of a Member of the Academy

 

Article 9. The Structure of the Academy

The structure of the Academy is defined by the Statute of the Academy.

Article 10. The Composition of the Academy

1. The total number of Full Members (Academicians) of the Academy should not exceed seventy.

2. A scientist/scholar – citizen of Georgia – who has made a contribution of   international significance to the development of Science and enjoys a high scientific prestige, may be elected a Full Member (Academician) or a Corresponding Member of the Academy.

3. A generally acknowledged scientist/scholar – citizen of Georgia – who has made a major contribution to the development of Georgian Science and Culture, may be elected an Honorary Academician.

4. An eminent Scientist or Scholar and a Public Figure – citizen of a foreign country – may be elected a Foreign Member of the Academy.

5. The activities of a Member of the Academy in the General Meeting and the Academic Council of the Academy should not be considered as execution of administrative functions.

Article 11. Election of a Full Member, a Corresponding Member, an Honorary Academi­cian, and a Foreign Member of the Academy

The rules of electing a Full Member (Academician), a Corresponding Member, an Honorary Academician and a Foreign Member of the Academy are defined by the Statute of the Academy.

 

 

Article 12. Allowance of a Member of the Academy

1. A lifetime monthly allowance of not less than GEL1,600 should be fixed for a Full Member (Academician) of the Academy.

2. A lifetime monthly allowance of not less then GEL1,000 should be fixed for a Corresponding Member of the Academy.

3. The payment of a Member of the Academy is funded by the State Budget of Georgia.

4. A Full Member (Academician) and a Corresponding Member of the Academy forfeits the allowance provided for by point 2 of this Article, if he/she renounces or loses Georgian citizenship.

5. The allowance envisaged by this Article corresponds to the scientific status of a Member of the Academy.

Chapter V

The Property of the Academy, Funding and State Control of the

Activities of the Academy

 

Article 13. The Property of the Academy

1. To implement the objectives set and the functions imposed on the Academy,  the Ministry of Economic Development of Georgia transfers relevant property to the Academy according to the rule established by Georgian Legislature.

2. If, according to article 10 of the Georgian Law of "Science and Technologies and their Development", a definite Research Institution constitutes itself into a structural unit of the Academy, the decision on the property to be transferred to it is taken by the Ministry of Economic Development of Georgia.

Article 14. Financing the Academy

1. The State Budget is the principal source of financing the Academy. The funds allotted to the Academy are itemized separately in the Georgian Law of the State Budget for the relevant year.

 

 

2. Additional Sources of Funding the Academy are:

a) state and private, including international and foreign countries, Funds supporting scientific research;

b) grants and revenues received from implementing contracts;

c) means that can be  received on the basis of Georgian Legislation.

Article 15. State Control of the Activities of the Academy

State monitoring of the activities of the Academy is carried out by the Georgian Ministry of Education and Science, in conformity with the rules set by Georgian Legislation.

Chapter VI

Article 16. The Georgian National Academy of Sciences, its Members (Acade­micians) and Corresponding Members

1. The Georgian National Academy of Sciences is a legal successor to the "Georgian Academy of Sciences".

2. The Full Members and Corresponding Members, Foreign and Honorary Members of the "Georgian Academy of Sciences" automatically acquire the status of Full Members (Academicians) and Corresponding Members, Honorary Academicians and Foreign Members of the "Georgian National Academy of Sciences".

3. Paragraph 4 of Article 12 of the present Law does not apply to those Full Members (Academicians) and Corresponding Members of the Academy, who had left Georgian citizenship prior to the passage of the present Law, or had lost Georgian citizenship.

4. The Statute of the Georgian National Academy of Sciences should be adopted not later than six months within the coming into effect of the present Law.

5. The election of the new Board of the Academy should take place not later than three months within the adoption of the present Law and the new Statute.

6. Elections of Corresponding Members to the Georgian National Academy of Sciences should be discontinued starting from the month of May, 2009.

7. The Georgian Academy of Agricultural Sciences functions by the current funding and by its own Statute.

8. The modern status of the Georgian Academy of Agricultural Sciences and the lifetime allowance of the Members of the Georgian Academy of Agricultural Sciences should be defined in February, 2008.

Article 17. Legislative Enactments Connected with the Adoption of the present Law

The Ministry of Economic Development of Georgia should ensure the transfer of property to the Academy in conformity with established regulations within three months of the implementation of the present Law.

 

Chapter VII

Closing Provisions

 

Article 18.  Act Becoming Invalid

The Georgian Law of the "Georgian Academy of Sciences" (Georgian Legislative Herald, N 25(32), 1999, Article 129) should be considered invalid from the moment the present Law is carried into effect.

Article 19.  Putting the Law in Force

The present Law should be put in force from 1 January, 2008.
